The National Energy Administration ("NEA") has recently issued the Measures on Talks About Power Safety Regulation (the "Measures").
The Measures state that, if a power enterprise falls under any of ten circumstances, including "having a major or more serious work safety accident", "having a relatively major work safety accident which is serious in nature and causes negative social impacts" and "having two or more relatively major work safety accidents within three months", the NEA will be responsible for organizing a talk with such enterprise. Meanwhile, the Measures expressly state that, individuals summoned to participate in such talks shall include primary persons responsible for work safety in power enterprises, heads specifically in charge of work safety and other relevant individuals. The authority with the responsibility for overseeing power safety shall prepare a plan for the talk, before it is held, and submit this plan to the head in charge of this work of the NEA (or the local energy regulator) for approval. After the proposed talk has been approved, the initiator of this talk shall notify in writing all participants of reasons why to hold the talk, when and where it will be held, among others. The participants shall prepare written documents in accordance with relevant requirements. Moreover, the Measures provide for other matters, including procedures for talks.
