The Ministry of Industry and Information Technology ("MIIT") has recently issued the Implementing Measures for the Record-filing of Sale of Radio Transmission Equipment (for Temporary Implementation) (the "Measures"), with effect from March 1, 2019.
The Measures clearly provide for the basis and the applicable scope, of the sale record-filing mechanism, administrative agencies, record-filing subjects, information requested for the filing purpose, operating procedures, etc., propose establishing a nationally unified record-filing information platform for the sale of radio transmission equipment, and set out requirements for supervision and inspection. According to the Measures, information to be filed under record includes the information about a business operator and on the equipment it deals in. The former covers the business operator's name, unified social credit code, contact person and contact information, address of its actual business place or name and address of the online platform where it trades the equipment, and relevant certificates, while the latter includes the equipment category, name of the equipment manufacturer, equipment mode, etc. In addition, the Measures clarify that to sell radio transmission equipment which requires an approval to its mode, the seller shall, within ten working days from the date the sale starts, carry out formalities on the said information platform to file a record for the sale with the provincial-level radio regulator for the place where it is registered.
