Centered on widely concerned violations and criminal behaviors that hamper safe driving and jeopardize the public order, the Opinions provide clarity on the application of law. Passengers who conduct highly dangerous actions that interfere with safe driving, including grabbing such operating devices as steering wheel or gear shift lever and beating or dragging drivers, will be convicted of and punished for the crime of endangering public security with dangerous methods. It is also highlighted that such passengers will generally not be granted probation even if their behaviors did not result in grave consequences. In addition, the Opinions stress that, those obstruct, in a violent or intimidatory way, the functionaries of state organs to deal with violations and criminal behaviors that hamper safe driving and to maintain the public transportation order, will be convicted of and punished for crime of obstructing public administration; more severe punishment will be given on those who violently attack police officers during their lawful duty performance. Furthermore, the Opinions require that in handling similar cases, courts, procuratorates and public security organs shall give comprehensive consideration to various factors, including speed at which the public transportation vehicle is running, and make thorough and accurate decisions, to fully embody their values in better defending the public transportation safety.
