The State Administration for Market Regulation ("SAMR") has recently issued the Administrative Provisions on the Recall of Consumer Goods (Draft for Comment) (the "Draft for Comment") to seek public comments by March 4, 2019.
Major changes introduced by the Draft for Comment, compared to the previous version, include cancelling the catalog-based administrative system, adjusting definitions of "consumer goods" and "recall", adding obligations of producers in information reporting and emergency response measures, further clarifying requirements for the record-filing of recall plans prepared by producers and the scope of products ineligible for recall, and introducing the punishment provisions. The Draft for Comment, comprising 34 articles and structurally organized into five individual chapters, stresses obligations of producers in accident reporting and information record-filing, to provide information and data support for the recall of consumer goods and for consumption warnings.
