The State Administration for Market Regulation ("SAMR") has recently issued the Measures for the Supervision and Administration of Salt Quality and Safety (for Trial Implementation, Draft for Comment) (the "Draft for Comment") for public consultation by May 14, 2019.
The Draft for Comment, comprised of 53 articles in six chapters, provides for, in Chapter II entitled Salt Production, production licensing, prohibited items, food additives and nutritional supplements, management bylaws, quality system, management personnel, health management and training of practitioners, enterprises' self-inspections, label management, whole-process recording, traceability system, and emergency management. Chapter III Salt Sale mainly sets forth requirements in respect of business licensing, prohibited items, management personnel and practitioners, management bylaws, salt-purchase channels, inspections of the purchased salt, sales records, self-inspections and storage, traceability system, and online sale management. Chapter IV entitled Supervision and Administration primarily sets out regulatory measures and requirements for interdepartmental coordination, covering risk surveillance, sampling inspections, level-based administration, regulatory checks, product recall, credit management, invitation of parties held liable to regulatory talks, complaints and reports, information disclosure, and referral of cases.
