The Ministry of Industry and Information Technology ("MIIT") has recently issued the Interim Implementation Plan for Fully Promoting the Administrative Law Enforcement Publicity System, the Law Enforcement Whole-process Recording System, and the Legal Review System for Major Law Enforcement Decisions (the "Plan").
Major contents of the Plan include: 1. clearly defining the objectives; 2. setting the tasks and the division of tasks; 3. clearly specifying the implementation steps and organizational guarantees; and 4. clarifying specific requirements for agencies affiliated to the MIIT. Among others, the Plan outlines key tasks for promoting the administrative law enforcement publicity system, the law enforcement whole-process recording system, the legal review system for major law enforcement decisions (collectively as "Three Systems"), and assigns the responsibilities for each task. As regards the law enforcement publicity, it is required to improve the publicity mechanism, intensify the publicity beforehand, standardize the in-process publicity, strengthen the ex-post publicity and publicize information in compliance with laws and the specification. With respect to the recording of the entire law enforcement process, it is required to promote the form of written records, standardize the audio and visual records, give play to the role of recording, and strictly manage the use of such records. When it comes to legal reviews for major law enforcement decisions, it is required to make clear which authorities will perform the legal reviews, the scope of decisions that will be reviewed to see their legality, what to be reviewed, and responsibilities in this regard.
