The Ministry of Transport ("MOT") has recently drafted the Draft Amendment to the Measures for Supervision and Administration of Security of the Postal Industry (Draft for Comment) (the "Draft for Comment") and the Draft Amendment to the Measures for Supervision of Postal Administrative Law Enforcement (Draft for Comment) to seek public opinions by June 15, 2019.
The Draft for Comment provides that postal service enterprises and express delivery enterprises shall abide by national provisions concerning security administration, and shall not endanger the national security or jeopardize social the public interest or legal rights and interests of others. The Draft for Comment also expressly states that a sender shall show his or her own valid identity card while posting a mail or express parcel, and fill in the express waybill with truthful information, adding that a postal service enterprise or an express delivery enterprise shall not accept a sender's mail or express parcel if he or she refuses to provide his or her identity information or provides unreal identity information. Moreover, the Draft for Comment stresses that postal service enterprises and express delivery enterprises shall, pursuant to requirements of China's classified cybersecurity protection system, fulfill five obligations with respect to security protection, including "taking such measures as data classification, back-up and encryption of important data", to protect their self-developed networks from any interference, damage or unauthorized access and prevent the leakage, theft or falsification of network data.
