Two Departments Announce the Arrangement for the Implementation of the Conformity Assessment System on the Limited Use of Hazardous Materials in Electric Appliances and Electrical Products
The State Administration for Market Regulation ("SAMR") and the Ministry of Industry and Information Technology ("MIIT") have recently enacted and issued the Arrangement for the Implementation of the Conformity Assessment System on the Limited Use of Hazardous Materials in Electric Appliances and Electrical Products (the Implementation Arrangement) which will take effect from November 1, 2019.
The Implementation Arrangement clearly states that the conformity assessment system on the limited use of hazardous materials in electric appliances and electrical products will be operated in two different forms, namely the voluntary certification for the limited use of hazardous materials in electric appliances and electrical products that is promoted by the state in a unified manner (the "voluntary certification mechanism") and the suppliers' conformity declaration for the limited use of hazardous materials in electric appliances and electrical products (the "self-declaration mechanism"). Further, the Implementation Arrangement states that the voluntary certification mechanism should be put into effect in accordance with requirements laid out in the Implementing Rules on Voluntary Certification for the Limited Use of Hazardous Materials in Electric Appliances and Electrical Products, adding that as regards the implementation of the self-declaration mechanism, suppliers shall report the corresponding information on product conformity in line with the Rules on Suppliers' Conformity Declaration for the Limited Use of Hazardous Materials in Electric Appliances and Electrical Products, after the product conformity assessment has been completed. Requirements for the use of relevant labels could be found in the Administrative Measures for the Use of Green Product Labels released by the SAMR.
