The State Administration for Market Regulation ("SAMR") has recently enacted and released, upon approval, the Licensing Rules for Units Engaged in Manufacturing and Filling of Special Equipment (the "Rules") for implementation.
The Rules expressly state that special equipment licenses are classified into two types, including the Special Equipment Production License of the People's Republic of China and the Mobile Pressure Vessel (Cylinder) Filling License of the People's Republic of China, and both will be valid for a period of four years. Also, the Rules state that an applicant shall have in place the resources, such as "personnel" and "workplaces", which are suitable for the licensed business scope and sufficient to meet production needs. The licensing procedures consist of the filing of applications, acceptance of applications, authentication and review, examination, and issuance of licenses. Applicants can submit applications and other materials online. In addition, the Rules provide that an applicant shall prepare the trial design documents and provide for the purpose of trial production or installation the sample machine (sample product) that has passed its own inspection and is accompanied by adequate documentation, in line with requirements set out in Annex B through Annex L to the Rules, prior to the authentication and review process, when it applies for the license for the first time, for the licensing of an additional business item, or for raising the level of licensing parameters.
