The Ministry of Ecology and Environment ("MEE") has recently issued the Control Standard for Fugitive Emission of Volatile Organic Compounds (GB 37822-2019), the Emission Standard for Atmospheric Pollutant from the Paint, Ink and Adhesive Industry (GB37824-2019) and the Emission Standard for Atmospheric Pollutant from the Pharmaceutical Industry (GB37823-2019) (the "Standard"), all of the standards will take effect from July 1, 2019.
The Standard clearly states that, newly-established enterprises and existing enterprises shall comply with this Standard for the control of atmospheric pollutant emissions, from July 1, 2019 and from July 1, 2020 respectively. Also, the Standard notes that enterprises shall, in accordance with applicable laws, the Administrative Measures for Environmental Monitoring, the standard HJ819 and other relevant provisions, establish the corporate monitoring system, prepare the monitoring plan, monitor by themselves the status of pollutant emissions and impact on the quality of surrounding environment, retain the original monitoring records, and publish the monitoring results. Meanwhile, enterprises shall design, create and maintain permanent sampling pedestals, sample testing platforms, and marks erected at pollutant outlets, pursuant to requirements set forth in the Administrative Measures for Environmental Monitoring and technical specifications in this regard.
