The Ministry of Transport ("MOT") has recently enacted and issued the Implementing Opinions on Deepening Regulation under the "Dual Randomness and One Publicity" Mode (the "Opinions").
Focused on the goal of carrying out regulation under the "dual randomness and one publicity" mode as a normal regulatory approach in all fields of the transport sector by the end of 2020, the Opinions outline three tasks including advancing regulatory inspections by randomly-selected inspectors among randomly-selected businesses, organizing and conducting such random inspections in a standardized manner and making better use of the results of joint inspections and inspections. Among others, the Opinions note that provincial transport authorities shall, according to the List of Inspected Items for Inspections under the Dual Randomness Mode and the list of randomly inspected items for market regulation prepared by the government at the same level, make overall arrangements to work out and improve their own list of items inspected in random inspections. The lists of inspected items should be dynamically adjusted in a timely manner according to the laws, regulations and rules newly formulated, amended, abolished and further interpreted and actual situations of regulatory work, and be made public. Furthermore, the Opinions require that differentiated and classified regulatory measures will be taken against inspection targets at different risk levels and with different credit status, adding that the percentage of the blacklisted market players facing random inspections and the frequency in which they will be randomly inspected will rise appropriately.
