The Ministry of Water Resources ("MWR") has recently drawn up and issued the Administrative Measures for Aggregation and Submission of Hydrologic Monitoring Data (Draft for Comment) (the "Draft for Comment") for public consultation by September 15, 2019.
Major contents of the Draft for Comment touch upon four aspects, including submitters and keepers of hydrologic monitoring data, the scope of hydrologic monitoring data to be aggregated and submitted, organizational procedures for aggregation and submission of hydrologic monitoring data, and management and sharing of hydrologic monitoring data. The Draft for Comment clearly states that entities engaged in monitoring of resources of surface water and underground water, water volume and water quality, and other entities engaged in hydrologic monitoring, shall submit the hydrologic monitoring data to the relevant hydrologic institutions according to their administration authority, adding that hydrologic institutions at all levels shall save and safekeep the hydrologic monitoring data they receive. In addition, the Draft for Comment states that the hydrologic monitoring data to be aggregated and submitted cover the outcomes of monitoring, survey of all hydrologic features and relevant compilation. For the sake of convenience and territorial jurisdiction, entities submitting the aforesaid data shall submit the data to the hydrologic institutions for the river basins at their respective place or the local hydrologic institutions according to the administration authority.
