The Department of Equipment Industry of the Ministry of Industry and Information Technology ("MIIT") has recently issued three documents, including the Evaluation Procedures for Application of Emerging Technologies, New Techniques or New Materials for Admittance of On-road Motor Vehicles (Draft for Comment) (the "Draft for Comment"), to seek comments from all walks of life by October 11, 2019.
The Draft for Comment reads that on-road motor vehicle manufacturers may file applications for exemption from relevant admittance conditions, if their products are unable to meet the admittance conditions laid out in the Administrative Measures for the Admittance of On-road Motor Vehicle Manufacturers and Their Products as a result of the application of emerging technologies, new techniques or new materials, and conduct the evaluation under these procedures. Also, the Draft for Comment expressly states that filing applications for exemption from relevant admittance conditions for on-road motor vehicles requires the submission of three documents, such as "a description of the application of emerging technologies, new techniques or new materials, and a statement on the impossibility to satisfy the relevant admittance conditions". Furthermore, the Draft for Comment notes that the MIIT shall make a decision within 20 working days on whether to grant the exemption from relevant admittance conditions, and notify the applicants in writing of its decision.
