The Ministry of Emergency Management ("MEM") has recently issued the Regulations on Coal Mine Safety (Draft for Comment) (the "Draft for Comment") to seek comments from the entities concerned by September 19, 2019.
The Draft for Comment is divided into ten chapters which are general provisions, coal mine safety access, primary responsibilities for coal mine safety, rights and obligations of practitioners engaged in coal mining business, national supervision of coal mine safety, local supervision and administration of coal mine safety, reporting of coal mine accidents and emergency rescue, investigation and handling of coal mine accidents, legal liability, and supplementary provisions. As to coal mine safety access, the Draft for Comment provides that a coal mine enterprise must fulfill several requirements, including "establishing and improving its work safety responsibility system, work safety bylaws, and operating procedures for different jobs", before building coal mines or carrying out coal production activities. The coal mine manager is required to have four job qualifications, such as "gaining over five years' experience in safe production of coal mines and over two years' experience in a technical or management post in relation to work safety", while the chief engineer of a coal mine shall have four job qualifications, such as "having over five years' experience in technical management of coal mines".
