The Ministry of Industry and Information Technology ("MIIT") has recently issued the Administrative Measures for Railway Radio (Draft for Comment) (the "Draft for Comment") for public comments by December 22, 2019.
Major contents of the Draft for Comment include: 1. clearly defining the responsibilities for administration of railway radio and establishing the long-term radio frequency protection mechanism; 2. establishing the mechanism on entrusting the licensing for use of radio frequency dedicated to operation security of railways; 3. detailing the specification for use and management of radio frequency dedicated to railways; 4. clarifying the establishment of radios (radio stations) and the division of duties concerning examination and approval of their use; 5. detailing the specification for use and management of radios (radio stations) dedicated to railways; 6. detailing the specification for management of radio transmitters; and 7. refining the mechanism for investigation and punishment of radio interference. Among others, the Draft for Comment makes clear the administrative authority for examination and approval of the licensing of use of radio frequency, and enriches the contents on the radio frequency use license. The railway industry is required to use radio frequency according to law and shall reduce radio frequency interference in railway hubs, adjacent railways and other regions.
