The National Development and Reform Commission ("NDRC") has recently issued the Interim Measures for Administration of Automotive Parts Remanufacturing (Draft for Comment) (the "Draft for Comment") for public comment by December 11, 2019.
The Draft for Comment is organized into eight chapters which are general provisions, good production practices of remanufacturers, management of old parts to be used for remanufacturing, management of remanufacturing production, management of remanufactured products, administration of the remanufacturing market, supervision and administration, and supplementary provisions. Among others, the Draft for Comment clearly states that an enterprise intending to engage in remanufacturing business shall satisfy seven conditions, including "being capable of recycling the old parts suitable for the remanufacturing production". Meanwhile, the Draft for Comment stipulates that remanufacturers are the bodies primarily responsible for the quality of remanufactured products, and shall set up a sound framework for remanufacturing quality management and have in place thorough bylaws, sufficient personnel and necessary equipment for remanufacturing quality control and quality inspections. Furthermore, the Draft for Comment encourages the publicity of remanufactured products to gradually raise the awareness of remanufactured products among consumers and foster the market for remanufactured products.
