The National Development and Reform Commission ("NDRC") has recently drawn up the Interim Administrative Measures for Recycling of Lead Storage Batteries and the Implementing Measures for the Extended Producer Responsibility System for Paper-based Composite Beverage Packaging (for Trial Implementation) and issued their exposure drafts to seek once again public comments by July 2, 2020.
According to the exposure draft, an enterprise manufacturing (importing) paper-based composite beverage packaging to be sold within the territory of China shall undertake extended producer responsibility (EPR) for recycling of discarded items, information publication, ecologically friendly design, etc. for the paper-based composite beverage packaging it has distributed and sold. Meanwhile, producers of paper-based composite beverage packaging shall clearly indicate on the packaging the information about the primary materials used in such packaging, and publish technical instructions on methods of packaging separation, recycling, etc. The exposure draft also provides that China will establish the system of the blacklist and the red list for the fulfillment of EPR by paper-based composite beverage packaging producers and dynamically update both lists. China will prioritize policy support to enterprises or consortiums on the red list, and will prompt relevant departments to take joint disciplinary actions against those blacklisted enterprises or consortiums.
