The Ministry of Commerce ("MOFCOM") has recently issued the Announcement on Adjusting the Catalog of Bulk Agricultural Products Subject to Import Reporting (the "Announcement").
The Announcement reads that sugar imported beyond the tariff quota is added to the Catalog of Bulk Agricultural Products Subject to Import Reporting, and will be governed by the import reporting requirement as of July 1, 2020. Foreign trade business operators that import the prescribed products shall fulfill the obligation of reporting relevant information on imports in accordance with the Administrative Measures for Import Reporting and Information Release for Bulk Agricultural Products. In addition, the Announcement clarifies that starting July 1, 2020, the import reporting requirement will be canceled for olive oil. The Announcement also requires that foreign trade business operators that import the prescribed products, shall file a record with the China Sugar Association ("CSA") if they are enterprises engaged in the processing and production of raw sugar, and with the China Chamber of Commerce of Import and Export of Foodstuffs, Native Produce and Animal By-products ("CFNA") if they are state-run sugar import trade enterprises or other types of sugar import enterprises; also, they shall forward a copy of the Record-filing Form of Enterprises Reporting Sugar Imports beyond the Tariff Quota to the provincial commerce authority of the place where they are registered respectively, and central enterprises located in Beijing shall forward the copy to the MOFCOM (Department of Foreign Trade).
