Recently, the Ministry of Industry and Information Technology ("MIIT") has issued the Decision on Revising the Administrative Provisions on the Access for New Energy Vehicle Manufacturers and Products (the "Decision"), with effect from September 1, 2020.
The Decision sets out main revisions in three aspects: the first is to remove the requirement on "design and development capacity", which must be satisfied to apply for entry as a new energy vehicle manufacturer. The original Article 5 and the contents related to "design and development capacity" set out in relevant annexes, including the Examination Requirements on Access for New Energy Vehicle Manufacturers, are deleted. The second is to adjust the duration for a new energy vehicle manufacturer to cease production from 12 months to 24 months. According to Paragraph 3, Article 34 of the Measures for the Access Administration of Road Motor Vehicle Manufacturers and Their Products, where a road motor vehicle manufacturer is unable to maintain normal production and operation for two consecutive years, special publicity is required. The special publicity requirement for new energy vehicle manufacturers should be consistent with that for the aforesaid road motor vehicle manufacturers. The third is to remove the interim provisions governing the applications for entry as new energy vehicle manufacturers during the transition period. In view of the revisions of the above clauses, the Decision also makes corresponding revisions of some annexes.
