According to the Circular of the General Office of the State Council on Transferring the Circular of Further Perfecting the Customs Duty Deposit System for the Processing Trade Issued by the State Economic and Trade Commission and Other Institutions Concerned (Guo Ban Fa [1999] No. 35), from October 1, 1999, the "actual transfer" of the customs duty deposit is to be implemented on certain commodities and enterprises in the processing trade. Hereby announced are the relevant regulations:

I. Registration of Processing Enterprises
According to the requirement on the "actual transfer" of the customs duty deposit, enterprises are to be administered under different categories. From October 1, 1999, the operating bodies of processing trade have to delegate processing tasks to processing enterprises that have registered with the appropriate local Customs. Processing enterprises that have not gone through such registration procedures shall register with the Department of Enterprise Administration of the appropriate Customs and apply for a processing enterprise code.

II. Filing, Examination and Approval of Contracts
1. From October 1, 1999, contract filing will not be conducted for processing enterprises without enterprise codes.
Filing of contracts will no longer be conducted for enterprises under the administration of Category D or contracts concerning prohibitive commodities.
