The Measures for the Parallel Administration of Average Fuel Consumption and New Energy Vehicle Credits for Passenger Vehicle Enterprises adopted at the 32nd ministerial meeting of the Ministry of Industry and Information Technology on August 16, 2017 are hereby promulgated as deliberated and agreed by the Ministry of Finance, the Ministry of Commerce, the General Administration of Customs and the General Administration of Quality Supervision, Inspection and Quarantine for implementation as of April 1, 2018.

Measures for the Parallel Administration of Average Fuel Consumption and New Energy Vehicle Credits for Passenger Vehicle Enterprises

Chapter I General Provisions

Article 1 In order to enhance the energy conservation level of passenger vehicles, ease the energy and environmental pressures, establish a long-term mechanism of energy conservation and new energy vehicle management, and promote the healthy development of the auto industry, these Measures are hereby formulated according to the Energy Conservation Law of the People's Republic of China and other provisions.

Article 2 These Measures apply to the administration of average fuel consumption and new energy vehicle credits of passenger vehicle enterprises within the territory of the People's Republic of China.

Article 3 The Ministry of Industry and Information Technology shall exercise administration over the average fuel consumption and new energy vehicle credits of passenger vehicle enterprises in concerts with the Ministry of Finance, the Ministry of Commerce, the General Administration of Customs and the General Administration of Quality Supervision, Inspection and Quarantine.

Article 4 For the purpose of these Measures, passenger vehicles refer to vehicles with the maximum design total mass of not exceeding 3,500 kg as stipulated in Paragraph 2.1.1.1 to Paragraph 2.1.1.10 of the Terms and Definitions of Motor Vehicles and Trailers (GB/T 3730.1 - 2001), including new energy and traditional energy passenger vehicles.
New energy passenger vehicles mentioned herein refer to passenger vehicles that are equipped with new power systems, and that are completely or mainly driven by new energy, including plug-in hybrid (including extended-range) passenger vehicles, blade electric passenger vehicles, fuel cell passenger vehicles, etc.
Traditional energy passenger vehicles as mentioned in these Measures refer to the passenger vehicles (including non-plug-in hybrid ones) that can be fueled with gasoline, diesel or gas fuel, except new energy passenger vehicles.

Article 5 Passenger vehicles enterprises include enterprises producing passenger vehicles and supplying imported passenger vehicles within the People's Republic of China.
For the purpose hereof, domestic passenger vehicle manufacturers refer to the passenger vehicle enterprises that have access to the passenger vehicle field granted by the Ministry of Industry and Information Technology and have obtained compulsory product certification.
Imported passenger vehicle suppliers mentioned herein refer to the passenger vehicle enterprises that import passenger vehicles from outside of the territory of the People's Republic of China and sell the same with compulsory product certification within the territory thereof, including imported passenger vehicle suppliers authorized by overseas passenger vehicle manufacturers and unauthorized imported passenger vehicle suppliers.

Article 6 The Ministry of Industry and Information Technology shall establish a platform governing the auto fuel consumption and new energy vehicle credits (the "Platform"), and shall co-ordinate efforts to promote the publicity, transfer and trading of the average fuel consumption and new energy vehicle credits.
Passenger vehicles enterprises shall report, as required by the Ministry of Industry and Information Technology (see Appendix I), data concerning the fuel consumption of passenger vehicles produced and imported and new energy passenger vehicles; the transfer or trading of credits shall be conducted via the Platform.

Chapter II Calculation of Average Fuel Consumption Credits for Passenger Vehicle Enterprises

Article 7 Domestic passenger vehicle manufacturers and imported passenger vehicle suppliers are independently subject to the calculation of average fuel consumption credits of passenger vehicle enterprises.

Article 8 Average fuel consumption credits of a passenger vehicle enterprise are calculated by multiplying the gap between its up-to-standard average fuel consumption and the actual consumption by the quantity of passenger vehicles it has produced or imported (rounded off to an integer).
Where the actual consumption is lower than the up-to-standard average fuel consumption, the credit will be positive; otherwise, it will be negative.

Article 9 The up-to-standard average fuel consumption of a passenger vehicle enterprise is calculated by multiplying the target average fuel consumption thereof by the average fuel consumption requirement in the accounting year concerned (rounded off to the second decimal).
The target average fuel consumption of a passenger vehicle enterprise is calculated according to Paragraph 5.2 of the Evaluation Measures and Indexes for Fuel Consumption of Passenger Vehicles (GB 27999 - 2014) (rounded off to the second decimal).
