Article 1 These Regulations are formulated for the purposes of protecting the legitimate rights and interests of individual businesses, encouraging, supporting and guiding the healthy development of individual businesses, strengthening the supervision and administration of individual businesses, and giving play to their important role in economic and social development and job enlargement.

Article 2 Individual businesses refer to citizens, with management ability, engaged in industrial and commercial businesses after going through registration formalities with industry and commercial administrations in accordance with these Regulations.
An individual business may be operated by the individual or his/her household.
Legitimate rights and interests of individual businesses are protected by laws and no unit or individual may infringe thereupon.

Article 3 Industrial and commercial administrations of counties, autonomous counties and cities not divided into districts are organs responsible for registration of individual businesses (hereinafter referred to as the "registration organs"). Registration organs may assign their governed industrial and commercial stations to handle registration of individual businesses.

Article 4 The State applies principles of equality in market access and fair treatment to individual businesses.
For an application for registration of an individual business, registration organs shall handle registration thereof in accordance with law provided that the business scope being applied for is not forbidden by laws or administrative regulations.

Article 5 Industrial and commercial administrations and other departments of the people's governments at or above the county level shall carry out supervision and administration over individual businesses in accordance with law.
Individual businesses' operation shall comply with laws, regulations, social morality and commercial ethics, keep faith and subject to law-based supervision of relevant departments.

Article 6 Local people's governments of all levels and relevant departments of the people's governments at or above the county level shall adopt measures to provide individual businesses with support, convenience, information consulting and other services in respects of business premise, entrepreneurship and vocational skills training, professional skills appraisal, technological innovation and participating in social insurance, etc.

Article 7 Individual laborers' associations established in accordance with law shall provide services, under direction of industrial and commercial administration, to individual businesses, protection their legitimate rights and interests and guide them to keep faith and take self-discipline.
Individual businesses may voluntarily choose to participate in individual laborer's associations.

Article 8 When applying for registration of individual businesses, applicants shall file registration applications with registration organs where business premises are located.
