Order of the Ministry of Land and Resources on Promulgating the Land Allocation Catalogue

Order of the Ministry of Land and Resources [2001] No. 9

The Land Allocation Catalogue which was adopted at the 9th executive meeting of the Ministry of Land and Resources on October 18, 2001 is hereby promulgated and shall come into effect as of the date of promulgation.

Attached: Land Allocation Catalogue

I. This Catalogue is formulated in line with the Land Administration Law of the People's Republic of China and the Law of the People's Republic of China on the Administration of the Urban Real Estate.

II. Where a project which involves the use of construction land is in conformity with this catalogue, the construction unit shall file an application, and the land use right shall be provided through the land allocation method only after the application is approved by the people's government with the approval authority.

III. For energy, communication, water conservancy and other infrastructure projects which involve the use of land, and receive key support from the state, the land use rights may be given through the land allocation method. For energy, communication, water conservancy and other infrastructure projects which involve the use of land for the profit-making purposes and do not receive key support from the state, the land use rights shall be provided with charge.

IV. Where the land use rights are obtained through the land allocation method, but the relevant project is no longer in conformity with this Catalogue due to corporate transformation, transfer of the land use rights or change in the purposes of land, the paid use of the land shall be implemented.

V. Where there are any other provisions in s laws, administrative regulations and relevant policies of the State Council after this Catalogue comes into effect, such provisions shall be followed.

VI. This Catalogue shall come into effect as of the date of promulgation. The Catalogue of Land Allocation Projects which was promulgated by the former State Land Administration shall be repealed simultaneously.

Appendix: Land for use by government organs and for military use

I. Land for use by CPC or government organs and people's organizations
1. Land used for office purposes;
2. Special and dedicated facilities for security, confidentiality and communications;

II. Land for military use
1. Command institutions, and above-ground and underground command projects and warfare projects;
2. Military camps, training grounds, and experiment sites;
3. Military highways, railways, airports, ports and docks;
4. Military cave depots and warehouses, and power, oil and gas transmission lines for military use;
5. Military mailing and, communication lines, reconnaissance and observation stations, and measurement and navigation signs;
6. Research and experiment facilities for national defense and military products; and
7. Other military facilities.
Land for urban infrastructure and public utility

III. Land for urban infrastructure
1. Water supply facilities: including water sources, water intake projects, water treatment plants, water conveyance and distribution projects, water quality testing centers, dispatch centers and control centers.
