The Decision of the State Council on Amending the Regulations on Publication Administration, which was adopted at the 147th executive meeting of the State Council on May 16, 2011, is hereby promulgated and shall come into effect as of the date of promulgation.

Decision of the State Council on Amending the Regulations on Publication Administration
The State Council decides to make amendments to the Regulations on Publication Administration as follows:
Article 1 "Publishing undertakings" in Article 1, Article 10 and Article 48 shall be amended to "publishing industry and publishing undertakings".
Article 2 Article 3 shall be amended to: "The publishing activities shall adhere to the orientation of serving the people and socialism, follow the guidance of Marxism-Leninism, Mao Zedong Thoughts, Deng Xiaoping Theory and the important thought of 'Three Representatives", implement the Scientific Outlook on Development, disseminate and accumulate science, technology and culture conducive to improvement of national quality, economic development and social progress, carry forward the excellent national culture, promote the international cultural exchanges, enrich and improve the spiritual life of the people."
Article 3 "Publishing administrative department" in article 6 through article 8, article 10, article 11, article 14, article 15, article 19, article 20, article 32, article 34, article 43 to article 45, article 47, article 53, article 55 through article 57, article 59, article 61 and article 62 shall be amended to "the competent publishing administrative department".
Article 4 "May check articles relating to illegal activities" in article 7 shall be amended to "may check articles and places of business relating to suspected illegal activities."
Article 5 Article 12 shall be amended to: "To establish a publishing unit, the sponsors thereof shall file an application with the competent publishing administrative department of the people's government of provinces, autonomous regions and municipalities directly under the Central Government where the publication unit is located; the filed application, after being examined and consented to by the said competent publishing administrative department, shall be submitted to the competent publishing administrative department of the State Council for examination and approval. In case the publishing unit to be established is an institution, the examination and approval procedures for institution organization shall be gone through."
Article 6 "Within 90 days from the date of receipt of the application for establishment of a publishing unit" shall be amended to "within 60 days upon acceptance of the application for establishment of a publishing unit."
Article 7 Paragraph 2 of Article 15 shall be amended to: "Upon receipt of a publishing permit, in case of an institution with legal person status, the publishing unit shall, presenting the publishing permit, register with institution registration administrative authority to acquire the Certificate of Institution with Legal Person Status while the enterprise with legal person status shall, presenting the publishing permit, register with the industrial and commercial administrative department to acquire a business license pursuant to the law."
Article 8 Article 17 shall be amended to: "Where the publishing unit changes its name, sponsor(s) or competent authority, business scope, capital structure, undergoes merger or division, establishes branches or subsidiaries, publishes new newspapers, periodicals, or the newspaper or periodical alters the name, it shall go through the examination and approval procedures pursuant to provisions of articles 12 and 13 of these Regulations. In case the publishing unit is the institution with legal person status, it shall also, presenting the approval documents, go through registration procedures with institution registration administrative authority accordingly while, the enterprise with legal person status shall, presenting the approval documents, go through registration procedures with the industrial and commercial administrative department."
"Modification of other items except as those specified in the preceding paragraph shall be subject to examination and consent of the sponsors and competent authority thereof, the publishing unit shall go through formalities for change of registration particulars with the competent publishing administrative department of the people's government of provinces, autonomous regions and municipalities directly under the Central Government where it is located, and report to the competent publishing administrative department of the State Council for the record. In case the publishing unit is an institution with legal person status, it shall, presenting the approval documents, go through formalities for change of registration particulars with the institution registration administrative authority while, the enterprise with legal person status shall, presenting the approval documents, go through formalities for change of registration particulars with the industrial and commercial administrative department."
Article 9 Article 18 shall be amended to: "Where the publishing unit suspends its publishing activities, it shall file the same to the competent publishing administrative department of the people's government of provinces, autonomous regions and municipalities directly under the Central Government for the record, and state the reasons and time limit of suspension; The suspension of publishing activities by a publishing unit shall not exceed 180 days.
"Where the publishing unit terminates its publishing activities, the sponsors thereof shall file an application with the competent authority, upon approval by such authority, the sponsors shall conduct procedures of cancellation of registration with the competent publishing administrative department of the people's government of provinces, autonomous regions and municipalities directly under the central government where it is located, and report to the competent publishing administrative department of the State Council for the record.
