Administrative Regulations on Registration of Overseas Manufacturers of Imported Food

The Administrative Regulations on Registration of Overseas Manufacturers of Imported Food was deliberated and passed by the Administrative Meeting of the General Administration of Quality Supervision, Inspection and Quarantine on June 21, 2011. It is hereby promulgated and shall take effect as of May 1st, 2012.

Chapter I General Provisions

Article 1 These Regulations are enacted pursuant to the laws and administrative regulations including the Food Safety Law of the People's Republic of China and the implementing rules thereof as well as the Law of the People's Republic of China on Imported and Exported Commodities Inspection and the implementing rules thereof, for the purpose of strengthening the supervision and administration on overseas food manufacturers of imported food.

Article 2 The registration, supervision and administration of overseas enterprises engaged in manufacturing, processing and storing food (hereafter referred to as the "overseas manufacturers of imported food") which export food to China shall be governed by these Regulations.

Article 3 The General Administration of Quality Supervision, Inspection and Quarantine (hereafter referred to as the "AQSIQ") shall be responsible for unified administration on registration of overseas manufacturers of imported food.
The Certification and Accreditation Administration of the People's Republic of China (hereafter referred to as the "CNCA") shall be responsible for organizing and carrying out the registration as well as supervision and administration of overseas manufacturers of imported food.

Article 4 The Implementing Catalogue of Registration for Overseas Manufacturers of Imported Food (hereafter referred to as the "Catalogue") shall be formulated and adjusted by CNCA and promulgated by AQSIQ.
The registration review procedures and technical requirements of different product categories in the Catalogue shall be formulated and promulgated by CNCA.

Article 5 The overseas manufacturers of food in the Catalogue shall be subject to registration before importing any product thereof.
