Administrative Regulations for the Surveying and Designing of Construction Projects

The Administrative Regulations for the Surveying and Designing of Construction Projects which were adopted at the 31st executive meeting of the State Council on September 20, 2000 is hereby issued and will take effect on the date of issuance.

Administrative Regulations for the Surveying and Designing of Construction Projects

Chapter I General Provisions
 
Article 1 These Regulations are enacted for the purpose of strengthening administration of surveying and designing activities carried out with respect to construction projects, guaranteeing the surveying and designing quality of construction projects and ensuring the safety of people's lives and property.
 
Article 2 These Regulations shall be applicable to surveying and designing activities carried out with respect to construction projects.
For the purposes of these Regulations, "surveying of a construction project" refers to any activity in which, according to the requirements of the construction project, the geological and geographical features and the geotechnical engineering properties of the construction site are ascertained, analyzed and evaluated and the surveying documents for the construction project are prepared.
"Designing of a construction project" refers to any activity in which, according to the requirements of the construction project, conditions required for the construction project such as technology, financial requirements, resources and environment are comprehensively analyzed and discussed, and the designing documents for the construction project are prepared.
 
Article 3 The surveying and designing of construction projects shall be consistent with the development of the economy and society and realize the unity of their economic, social and environmental benefits.
 
Article 4 Whoever is engaged in the activities of surveying and designing construction projects shall follow the principle of surveying first, then designing and finally carrying out the construction.
 
Article 5 The competent administrative departments for construction and relevant departments for transport and water conservancy and other affairs under the people's governments at or above the county level shall, pursuant to these Regulations, make more efforts to supervise and administer the activities of surveying and designing construction projects.
Entities which survey or design construction projects shall survey or design construction projects in accordance wit the law, strictly implement the compulsory criteria for construction projects, and be responsible for the surveying or designing quality of construction projects.
 
Article 6 The State will encourage the application of advanced technologies, process and equipment, new materials and modern management methods in the activities of surveying and designing construction projects.

Chapter II Qualification Management
 
Article 7 The State will apply a qualification management system to entities engaging in the activities of surveying or designing construction projects. The specific measures therefor shall be formulated by the competent administrative department for construction under the State Council in consultation with the relevant departments of the State Council.
 
Article 8 Any entity which surveys or designs construction projects shall undertake the surveying or designing of construction projects within the permitted scope of their qualifications.
No entity which surveys or designs construction projects shall undertake the surveying or designing of construction projects beyond the permitted scope of its qualifications or in the name of another entity which surveys or designs construction projects. No entity which surveys or designs construction projects shall allow another entity or any individual to undertake the surveying or designing of construction projects in its name.
 
Article 9 The State will apply the practitioner qualification registration and management system to the professional technicians engaging in the activities of surveying or designing construction projects.
No uncertified surveyor or designer for construction projects may engage in the activities of surveying and designing construction projects in the name of a certified practitioner.
 
Article 10 A certified practitioner and any other professional technician for the surveying or designing of construction projects shall be employed by only one entity which surveys or designs construction projects; any certified practitioner or professional technician who is not employed by an entity which surveys or designs construction projects may not engage in the activities of surveying or designing construction projects.
 
Article 11 The qualification certificates for entities surveying or designing construction projects and the certificates for certified practitioners shall be prepared uniformly by the competent administrative department for construction under the State Council.

Chapter III Contracting and Undertaking of Surveying or Designing of Construction Projects
 
Article 12 The surveying or designing of a construction project shall be contracted out through bidding or in a direct manner in accordance with the law.
 
Article 13 The surveying or designing of a construction project shall be contracted out through bidding in accordance with the provisions of the Tendering and Bidding Law of the People's Republic of China.
 
Article 14 Bids for the plan for the surveying or designing of a construction project shall be assessed comprehensively on the basis of the achievements and credit of bidders, the competence of surveyors or designers and the quality of the surveying or designing plan.
 
Article 15 The tenderee for the surveying or designing of a construction project shall decide the bid winner among the candidate plans recommended by the bid assessment committee.
