Proposals of the State Council for Institutional Reforms and Functional Transformation

In accordance with the spirits of the Eighteenth National Congress of the Communist Party of China and the Second Plenary Session of the Eighteenth Central Committee of the Communist Party of China, with a view to deepening the institutional reforms and functional transformation of the State Council, we must hold high the great banner of socialism with Chinese characteristics, follow the guidance of Deng Xiaoping Theory, the important thought of Three Represents and the Scientific Outlook on Development, meet the requirements to reach the goal of establishing a socialist administrative system with Chinese characteristics, take the functional transformation as a core, continue to streamline administration and delegate more power to lower levels, promote the institutional reforms, improve the systems and mechanisms as well as the administrative efficiency, accelerate the improvement of the socialist market economic system, and provide the institutional securities for completing the building of a moderately prosperous society in all respects.

On institutional reforms of the State Council

Centered closely on the transformation of functions and rationalization of responsibilities, the emphasis of these reforms is on the steady promotion of large-scale departmental reform, the implementation of the separation of government and enterprise in the railway industry and the integration and strengthening of the administrative institutions for health and family planning; food and drugs; press and publication, radio, film and television; marine; and energy resources.

I. Implement the separation of government and enterprise in the railway industry. With a view to promoting the healthy and sustainable development in the construction and operation of railways, ensuring the order and safety during the operation of railways and promoting the interconnections among all kinds of traffic and transportation modes, implement the separation of government and enterprise in the railway industry and improve the comprehensive traffic and transportation system. The administrative functions of the Ministry of Railways ("MOR") in respect of formulating plans and policies for the development of railways shall be transferred to the Ministry of Transport ("MOT"). The MOT shall take overall considerations to plan the development of the railways, roads, waterways and the civil aviation and accelerate the construction of the comprehensive traffic and transportation system. The State Railway Administration shall be established, administered by the MOT, undertake the other administrative responsibilities of the MOR, take charge of formulating the technical standards of railways, and supervise and manage the safety production of railways, transportation service quality and the engineering quality of railways. The China Railway Corporation shall be established, undertake the commercial responsibilities of the MOR, take charge of the uniform dispatching and command of railway transportation, manage the passengers and goods transportation businesses on railways, undertake any special transportation tasks, take charge of the construction of railways, and undertake the master responsibilities in safe production of railways.
The State will continue to support the construction and development of railways, accelerate the reforms of the investment and financing system and the transportation prices, establish and improve the standard lines for public interests and the mechanism of transportation subsidies and continue to deepen the reforms of the railway enterprises.
The MOR shall be removed.

II. Establish the National Health and Family Planning Commission ("NHFPC"). With a view to adhering to the basic state policy of family planning, strengthening the medical and health works, deepening the reform of medicine and health system, optimizing the allocation of medical and health and family planning service resources and improving the quality of health of newborns and people's health, the NHFPC shall be established by integrating the responsibilities of the Ministry of Health ("MOH") and the responsibilities of family planning administration and service of the National Population and Family Planning Commission ("NPFPC"). The main responsibilities of the NHFPC are to make overall plans for the allocation of medical and health and family planning service resources, organize and formulate the national systems for basic drugs, formulate the policies of family planning, supervise and administer the public health and medical services and take charge of the family planning administration and services.
The responsibilities of the NPFPC in respect of researching and formulating population development strategies and plans as well as population policies shall be transferred to the National Development and Reform Commission ("NDRC").
The State Administration of Traditional Chinese Medicine ("SATCM") shall be administered by the NHFPC.
The MOH and the NPFPC shall be removed.

III. Establish the General Administration of Food and Drugs ("GAFD"). With a view to strengthening the supervision and administration of food and drugs and improving the safety quality level of food and drugs, the GAFD shall be established by integrating the responsibilities of the Office of the Food Safety Commission of the State Council ("OFSCSC"), the responsibilities of the State Food and Drug Administration ("SFDA"), the supervision and administration responsibilities the General Administration of Quality supervision, Inspection and Quarantine of the People's Republic of China for the food safety in production link, and the supervision and administration responsibilities of the State Administration for Industry & Commerce of the People's Republic of China for the food safety in circulating link.
