Interim Measures for the State-Owned Assets Administration of Administrative Units

Chapter I General Provisions

Article 1 With a view to standardizing and strengthening the administration of the state-owned assets of administrative units, maintaining the safety and integrity of the state-owned assets, rationally allocating the state-owned assets, increasing the utilization benefit of the state-owned assets and guaranteeing the functions and duties of administrative units, we, in accordance with the relevant regulations of the State Council, worked out these Measures.

Article 2 These Measures shall be applicable to the administration of the state-owned assets of Party organs, organs of the National People's Congress, administrative organs, organs of the political consultative conference, judicial organs, prosecutorial organs and organs of all democratic parties (hereinafter uniformly referred to as administrative units) at all levels.

Article 3 The "state-owned assets of administrative units" as mentioned in these Measures refer to various economic resources that are possessed and utilized by administrative units at all levels, are identified to be owned by the State and are measurable by money value, namely, the state-owned assets of administrative units.
The state-owned assets of administrative units include the assets formed by state financial capital, assets appropriated by the State to administrative units, assets formed by administrative units' revenue organization in accordance with the regulations of the State, assets formed by donation and other assets that have been identified to be owned by the State in accordance with law, in the forms of fixed assets, current assets, intangible assets, etc.

Article 4 The major tasks in the administration of the state-owned assets of administrative units are as follows:
1. Establishing and improving various rules and regulations;
2. Promoting the reasonable allocation and effective utilization of the state-owned assets;
3. Guaranteeing the safety and integrity of the state-owned assets; and
4. Supervising the state-owned assets of the economic units that are still under the state administration so as to maintain and increase the value of the state-owned assets.

Article 5 The administration of the state-owned assets of administrative units includes: allocation of assets, utilization of assets, disposal of assets, appraisal of assets, delimitation of property rights, investigation into and settlement of property rights, registration of property rights, inspection of assets, statistical reports of assets, the supervision and examination of assets, etc.

Article 6 The administration of the state-owned assets of administrative units shall be subject to the following principles:
1. Combination of assets administration and budgetary administration;
2. Combination of assets administration and financial administration; and
3. Combination of physical administration and value administration.

Article 7 The administration of the state-owned assets of administrative units shall be subject to the administrative system of uniform ownership by the state, level-to-level supervision and administration by governments, and possession and utilization by units.

Chapter II Administrative Institutions and Functions and Duties Thereof

Article 8 Financial departments at all levels are the functional departments in charge of the administration of the state-owned assets of administrative units, which conduct comprehensive administration of the state-owned assets of administrative units by performing major functions and duties as follows:
1. Implementing the relevant laws, regulations and policies of the State on the administration of the state-owned assets;
2. Working out the rules and regulations for the administration of the state-owned assets of administrative units, and supervising and examining their implementation in accordance with the relevant regulations of the State on the administration of the state-owned assets;
3. Being responsible for studying and working out the standards for allocating the state-owned assets of administrative units at the same level in coordination with the relevant departments, approving and examining allocation of assets, approving and examining allocation of assets and changes in property rights in accordance with the relevant provisions, and organizing the delimitation of property rights, investigation into and settlement of disputes on property rights, preparation of statistical reports of assets, asset appraisal, asset inspection, etc.;
4. Being responsible for examining and approving the lease of the state-owned assets of administrative units at the same level, and supervising and administrating the state-owned assets of the economic units that are still under administrative units;
5. Being responsible for supervising and administrating the lease of the income from the state-owned assets of administrative units at the same level, and supervising and administrating the state-owned assets of the economic units at the same level;
