Decision of the Standing Committee of the National People's Congress on Punishing the Crimes of Fraudulent Purchase of Foreign Exchange, Foreign Exchange Evasion and Illegal Foreign Exchange Trading was adopted at the 6th Meeting of the Standing Committee of the 9th National People's Congress on December 29, 1998 and is hereby promulgated, and shall come into effect as of the date of promulgation.

Decision of the Standing Committee of the National People's Congress on Punishing the Crimes of Fraudulent Purchase of Foreign Exchange, Foreign Exchange Evasion and Illegal Foreign Exchange Trading
For purposes of punishing the criminal acts of fraudulent purchase of foreign exchange, foreign exchange evasion and illegal foreign exchange trading and maintaining the order of the state's foreign exchange control, the supplementary revisions are made in the Criminal Law of the People's Republic of China as follows:
I. Whoever, in any of the following circumstances, purchases foreign currency of a relatively large amount by deceitful means shall be sentenced to fixed-term imprisonment of not more than 5 years or criminal detention, and sentenced concurrently to a fine of more than 5% less than 30% of the amount of foreign currency purchased by deceitful means; where it constitutes a great amount or involves other serious circumstances, he shall be sentenced to a fixed-term imprisonment of more than 5 years less than 10 years and concurrently to a fine of more than 5% less than 30% of the amount of foreign currency purchased by deceitful means shall be imposed; where it constitutes an extremely great amount or involves other extremely serious circumstances, a fixed-term of imprisonment of more than 10 years or life imprisonment shall be imposed, and a fine of more than 5% less than 30% of the amount of foreign currency purchased by deceitful means shall be concurrently imposed or properties confiscated:
