Order of the Ministry of Land and Resources on Promulgating the Regulations for Usufruct Transfer of State-owned Land through Agreements

The Regulations for Usufruct Transfer of State-owned Land through Agreements has been approved on the 6th ministerial meeting of the Ministry of Land and Resources on June 5, 2003. The Regulations are hereby promulgated and shall come into effect on August 1, 2003.

Article 1 These Regulations are formulated in accordance with the Law of the People's Republic of China on the Administration of the Urban Real Estate, Law of Land Administration of the People's Republic of China and Regulations for the Implementation of the Land Administration Law of the People's Republic of China, with the purpose of enhancing the management of state-owned land assets, optimizing land resource allocation, and normalizing usufruct transfer activities of state-owned land.
 
Article 2 These Regulations shall apply to all the usufruct transfers of state-owned land within China.
The usufruct transfer of state-owned land through agreements, as mentioned in these Regulations, refers to the activity that the state transfers the usufruct of state-owned land to land users for certain years while land users pay the state the transfer fee for land usufruct through agreements.
 
Article 3 The usufruct of state-owned land can be transferred through agreements only when other means including bid invitation, auction or listing are not required by laws, rules or regulations.
 
Article 4 The usufruct transfer of state-owned land through agreements shall comply with the principles of openness, equity, justice and integrity.
