Administrative Measures for Certified Real Estate Appraisers

Adopted at 86th executive meeting of the Ministry of Construction on March 7, 2006, the Administrative Measures for Certified Real Estate Appraisers are hereby promulgated and shall come into effect as of March 1, 2007.

Appendix: Administrative Measures for Certified Real Estate Appraisers

Chapter I General Provisions

Article 1 With the purpose of strengthening the administration of certified real estate appraisers, perfecting the appraisal system of real estate and qualification certification system thereof, regulate the practice of certified real estate appraisers, protect the public interest and the market order of the real estate appraisal, these Measures are formulated in accordance with the Law of the People's Republic of China on the Administration of the Urban Real Estate and the Administrative Licensing Law of the People's Republic of China as well as other relevant laws and administrative regulations.

Article 2 These Measures apply to the registration, practice, further education, supervision and management of certified real estate appraisers in China.

Article 3 The term "certified real estate appraiser" as mentioned in these Measures refers to a professional engaging in the practice of real estate appraisal, who passed the qualification examination for national real estate appraisers, or qualification certification or mutual reorganization of qualification, received the practice qualification for real estate appraise of the People's Republic of China(hereinafter refers to the practice qualification), and obtained the registered certificate for real estate appraises of the People's Republic of China(hereinafter refers to the registered certificate ).

Article 4 Certified real estate appraisers shall be subject to the certified practice management system.
A professional who has received the practice qualification may not practice by the name of a certified real estate appraiser until he is registered.

Article 5 The competent departments of the Ministry of Construction shall carry out uniform supervision and administration on the national registration and practice of the certified real estate appraisers.
The competent construction(real estate)departments of provinces, autonomous regions and municipalities directly under the Central Government shall carry out uniform supervision and administration on the registration and practice of the certified real estate appraisers within the administrative region thereof.
The competent construction(real estate)departments of municipalities, counties, and municipal districts shall carry out uniform supervision and administration on the registration and practice of the certified real estate appraiser within the administrative region thereof.

Article 6 Real estate appraisal organizations shall strengthen the self-discipline management of certified real estate appraisers.
Certified real estate appraisers are encouraged to join the trade organization of real estate appraisal.

Chapter II Registration

Article 7 The conditions for registration of certified real estate appraiser are as followings:
1. Received practice qualification;
2. Achieved qualified standard of further education;
3. Having been employed by a qualified real estate appraisal institution;
4. Without circumstances under which the registration shall not be approved as prescribed in Article 14 of these Measures.

Article 8 To apply for registration, an applicant shall file a registration application to the construction (real estate) administrative department of the people's government of the province, autonomous region, or municipality directly under the Central Government in the place where the industrial and commercial registration place of the employing entity or its branch is located.
In regard to the initial registration application, the competent construction (real estate) departments of provinces, autonomous regions and municipalities directly under the Central Government shall complete the examination within 20 days as of the date of the acceptance of the application, and submit the application materials and initial examination opinion to the competent departments of the Ministry of Construction, which shall make the decision within 20 days as of the date of acceptance.
In regard to the application for changing or extending the registration, the competent construction (real estate) departments of provinces, autonomous regions and municipalities directly under the central government shall complete the examination within 5 days as of the date when accepting the application, and submit the application materials and initial examination opinion to the competent departments of the Ministry of Construction, which shall make the decision within 10 days as of the date of acceptance.
The application, acceptance and approval of initial registration, change or extension of registration of the certified real estate appraiser may be carried out online step by step.

Article 9 The certified certificate shall be the practice certificate for the certified real estate appraiser, the term of validation is 3 years.

Article10 To apply for initial registration, an applicant shall submit the following materials:
