In order to implement the deployment of the Third and the Fourth Plenary Sessions of the 18th Central Committee of the Communist Party of China on the reform of the people's juror system, further promote the judicial democracy, improve the people's juror system, ensure the orderly participation of the masses in justice, enhance the public trustworthiness of the people's juror system and boost the judicial fairness, the Pilot Program of the People's Juror System Reform has been formulated by the Supreme People's Court and the Ministry of Justice and adopted at the 11th meeting of the Central Leading Group for Comprehensively Deepening Reforms. The Decision on the Authorization on the Implementation of Pilot Reform of the People's Juror System in Certain Regions made on the 14th Session of the Standing Committee of the 12th National People's Congress provides a legal basis for the reform. The Pilot Program of the People's Juror System Reform is hereby issued to you for your earnest organization and implementation. In case of any problem in the implementation thereof, please promptly report to the Supreme People's Court and the Ministry of Justice.
Pilot Program of the People's Juror System Reform
In order to implement the deployment of the Third and the Fourth Plenary Sessions of the 18th Central Committee of the Communist Party of China on the reform of the people's juror system, the pilot program for the people's juror system reform is proposed as follows:
I. Basic Principles and Reform Objectives
The people's juror system is an important part of the socialist judicial system with Chinese characteristics. Through the reform of the people's juror system, advance the judicial democracy, promote the judicial fairness, ensure the orderly participation of the masses in justice and improve the public trustworthiness of the people's juror system and the judicial credibility, so as to enable the masses to feel the sense of fairness and justice in each judicial case.
1. Stick to the correct political orientation. During the course of reform, always insist on the organic unity of the leadership of the Communist Party of China, the position of the people as masters of the country and law-based governance, keep firmly to the path of socialist rule of law with Chinese characteristics, and adhere to the mass line in the people's judicial work, so as to improve the public trustworthiness of the people's juror system.
2. Stick to advancing the reform in an orderly manner and in accordance with the law. The people's juror system reform shall be carried out in accordance with law; where it is needed to carry out pilot programs due to the immature conditions for reform, the authorization shall be granted by the legislative body in accordance with the legal procedures and reform measures that have proven effective in practice must be timely upgraded to laws, in a bid to ensure the orderly advancing of the reform under the legal framework.
