The administrations for industry and commerce and market regulatory departments of all provinces, autonomous regions, municipalities directly under the Central Government, cities specifically designated in the state plan and sub-provincial cities,
In order to comply with the arrangements and requirements of the State Council on streamlining administration, delegating more power to lower-level governments and society, improving regulation and optimizing services, further revitalize the market and encourage mass entrepreneurship and innovation, the State Administration for Industry and Commerce ("SAIC")decides to further deepen the reform of the commercial system and vigorously facilitate trademark registration.
I. The general ideas of the reform
Guided by the spirit of the 18th National Congress of the Communist Party of China and the Second, Third, Fourth and Fifth Plenary Sessions of the 18th CPC Central Committee, we shall implement the trademark brand strategy in an attempt to address problems in trademark registration and administration and facilitate trademark registration. In this regard, we shall facilitate applicants applying for trademark registration, boost trademark approval efficiency, improve the quality of public trademark service, better leverage the leading role of brands and promote the development of brand economy by opening up trademark application channels, simplifying trademark registration procedures, optimizing trademark registration process, improving trademark examination system and strengthening trademark credit regulation.
II. Opening up trademark application channels to facilitate applicants
1. Entrusting local competent departments with the task of accepting trademark applications. Entrusted by the Trademark Office, local industry and commerce administrative authorities and market regulatory authorities shall establish trademark registration offices at local government affairs halls or registration halls to process trademark registration applications and provide other services on behalf of the Trademark Office. In 2016, pilot programs are launched in the regions such as Ya'an of Sichuan and Taizhou of Zhejiang. We will set up more trademark registration offices in view of the practical effects of the pilot programs in due course.
2. Establishing trademark examination cooperative centers outside Beijing. By taking account of regional economic development phase and the scale of local trademark application, we shall rationally plan general layout and establish trademark examination cooperative centers outside Beijing. Entrusted by the Trademark Office, trademark examination cooperative centers shall be responsible for examining trademark and providing other services. The pilot programs were initiated in 2016 and more trademark examination cooperative centers will be set up in due course in the light of practical effects of the pilot programs and service requirements.
