Administrative Measures for the Review of the Safety of New Raw-food Materials

The Administrative Measures for the Review of the Safety of New Raw-food Materials, adopted after deliberation at the executive meeting of the former Ministry of Health on February 5, 2013, are hereby announced for implementation as of October 1, 2013.

Administrative Measures for the Review of the Safety of New Raw-food Materials
Article 1 The Administrative Measures for the Review of the Safety of New Raw-food Materials (hereinafter referred to as the "Measures") are formulated in accordance with the Food Safety Law of the People's Republic of China with a view to regulating the review of the safety assessment materials on new raw-food materials.
Article 2 New raw-food materials refer to the following materials that are not traditional eating habits in China:
1. animals, plants and microorganisms;
2. components separated from animals, plants and microorganisms;
3. food ingredients whose original structures change; and
4. other newly developed raw-food materials.
Article 3 New raw-food materials shall have the characteristics of raw-food materials, conform to proper nutritive requirements, be avirulent and harmless, and cause no acute, subacute, chronic or other potential hazards to human health.
Article 4 New raw-food materials may be used for food production and trading only after they pass the safety review by the National Health and Family Planning Commission.
Article 5 The National Health and Family Planning Commission will be responsible for reviewing and licensing safety assessment materials on new raw-food materials.
The Health Supervision Center under the National Health and Family Planning Commission will be responsible for accepting the declaration for safety assessment materials on new raw-food materials, and organizing the review of safety assessment materials.
Article 6 Any entity or individual intending to engage in the production, use or import of new raw-food materials (hereinafter referred to as the "Applicant") shall file an application and submit the following materials:
