All departments, divisions, bureaus and offices under the National Development and Reform Commission, the State Administration of Grain and the National Energy Administration,
Since the issuance of the Opinions of the State Council on Establishing a Fair Competition Review System in the Development of the Market System (Guo Fa [2016] No.34, the "Opinions"), the National Development and Reform Commission ("NDRC") has been carefully implementing the Opinions. The NDRC has issued the Circular on Implementing the Internal Work Procedures under the Opinions, and has embedded the fair competition review item in the online office system. All divisions and bureaus under the NDRC have been conducting reviews in an orderly manner and in the principle that "the department which drafts provisions shall be responsible for conducting related reviews". A few days ago, the NDRC, upon approval by the State Council, issued the Implementing Rules for the Fair Competition Review System (for Interim Implementation) (Fa Gai Jia Jian [2017] No.1849, the "Implementing Rules") in conjunction with the Ministry of Finance, the Ministry of Commerce, the State Administration for Industry and Commerce and the Legislative Affairs Office, which define and detail examination procedures, examination standards, exceptions, supervision and accountability and other issues.
