The Decision of the Standing Committee of the National People's Congress on Revising the Law of the People's Republic of China on the Promotion of Privately-run Schools, adopted at the 24th Session of the Standing Committee of the 12th National People's Congress of the People's Republic of China on November 7, 2016, is hereby promulgated for implementation as of September 1, 2017.

Decision of the Standing Committee of the National People's Congress on Revising the Law of the People's Republic of China on the Promotion of Privately-run Schools

(Adopted at the 24th meeting of the Standing Committee of the 12th National People's Congress on November 7, 2016)

It was decided at the 24th Session of the Standing Committee of the 12th National People's Congress to revise the Law of the People's Republic of China on the Promotion of Privately-run Schools as follows:

I. One article is added to Chapter I as Article 9 which reads: "The grassroots organizations of the Communist Party of China in privately-run schools shall carry out Party activities in accordance with the Constitution of the Communist Party of China and strengthen party building."

II. Article 18 is changed to be Article 19 and revised to read: "Sponsors of privately-run schools may set up, at their sole discretion, non-profit or for-profit privately-run schools. But they may not establish for-profit privately-run schools providing compulsory education.
Sponsors of non-profit privately-run schools may not obtain proceeds from running the schools, and all school-running balances shall be used for running schools.
Sponsors of for-profit privately-run schools may obtain proceeds from running the schools, and the school-running balances shall be disposed of in accordance with the provisions of the Company Law and other relevant laws and administrative regulations.
Registration authorities shall handle, in accordance with the law, the registration of privately-run schools as legal persons after they obtain the licenses for running the schools."

III. Article 19 is changed to be Article 20 and revised to read: "A privately-run school shall set up an executive council, a board of directors or other forms of decision-making bodies of the school and establish the corresponding supervisory mechanisms.
Sponsors of privately-run schools shall participate in the running and management of the schools in accordance with the authority and procedures stipulated in the articles of association of the schools."
