To thoroughly study and implement Xi Jinping's Thought on Socialism with Chinese Characteristics for a New Era and the spirit raised at the 19th National Congress of the Communist Party of China, earnestly put in place major decisions and plans made by the Central Committee of the Communist Part of China, with Comrade Xi Jinping at its core, to support the fully deepened reform and opening-up in Hainan, give full play to the functions of people's courts, and promote the building of the Pilot Free Trade Zone and the free trade port with Chinese characteristics in Hainan, the following opinions are raised in accordance with the Guiding Opinions of the Central Committee of the Communist Party of China and the State Council on Supporting Hainan to Fully Deepen Reform and Opening-up and the Opinions of the Supreme People's Court on Providing Judicial Safeguards to the Construction of Free Trade Zones.
I. Practically Raising the Political Stance and Increasing the Sense of Responsibility and Sense of Mission for Providing Judicial Services and Guarantees for Fully Deepened Reform and Opening-up in Hainan
1. Gain an insightful understanding of the significance of deepening reform and opening-up in all aspects in Hainan and provide further clarity on the historical mission of people's courts. Against the background of Socialism with Chinese characteristics in the new era, assigning a new mission to the reform and opening-up in the Hainan special economic zone is a significant national strategy worked out, planned and promoted in person by General Secretary Xi Jinping, and will be beneficial to improving and developing the socialist system with Chinese characteristics, accelerating the formation of a new situation of all-round opening-up, and turning Hainan into a highlight of socialism with Chinese characteristics in the new era. All levels of people's courts shall remain guided by Xi Jinping's Thought on Socialism with Chinese Characteristics for a new era, remain committed to the underlying principle of making progress while keeping performance stable, persist in the new development philosophy, have a correct understanding of the guidelines, strategic positioning, basic principles and development objectives of the fully deepened reform and opening-up in Hainan, give full play to the functions of justice, try relevant cases in a legal, fair and efficient manner, deepen the judicial system reform, strengthen the building of smart courts, and constantly improve the judicial capacity and level, so as to provide strong judicial services and guarantees for building Hainan into a pilot zone for fully deepened reform and opening-up, a national eco-civilization pilot zone, an international tourism and consumption center and a national service and guarantee zone for major strategies.
2. Find a proper pioneering area to provide judicial services and guarantees for the fully deepened reform and opening-up in Hainan. Persisting in the rule of law thinking, focus on serving and guaranteeing key areas in fully deepening reform and opening-up in Hainan, conduct careful studies of new situations and solve new problems, formulate judicial policies, introduce judicial interpretations and improve the working mechanisms in a timely manner, so as to ensure scientific decision-making and effective implementation. Increase the consciousness of the overall situation, establish and improve the unified coordination mechanism, give full play to the functions of the first circuit court of the Supreme People's Court, and ensure the coordination and efficiency of various work. Improve the trial mechanism, innovate working methods, improve the quality and efficiency of trials, refine the rules of judgment, unify the standards of judgment, and practically improve the capacity for and level of judicial services and guarantees.
II. Giving Full Play to Judicial Functions and Prompting Hainan to Form a Law-based, Internationalized and Convenient Business Environment and a Fair, Open and Unified Market Environment
3. Strengthen trials of criminal cases and severely crack down on various criminal offenses that affect the fully deepened reform and opening-up in Hainan.
