Chapter I General Provisions
Article 1 With the goal of standardizing the administration of the manifests of vehicles crossing Customs barriers, facilitating international trade and ensuring the security thereof, these Procedures are formulated on the basis of the provision of the Customs Law of the People's Republic of China (hereinafter Customs Law) and relevant laws and administrative regulations.
Article 2 For the purposes of these Procedures, manifests of vehicles crossing Customs barriers (hereinafter simply "manifests") are repositories of information regarding the goods, materials, and passengers on board a vehicle entering or leaving Chinese territory, including original manifests, advance manifests, and cargo (passenger) manifests.
Where vehicles crossing Customs barriers are carrying goods and materials, the information in the manifest should include the general bill of lading (BOL) and any sub-BOLs.
Article 3 These Procedures are applicable to Customs administration over the manifests of ships, aircraft, trains, and automotive vehicles crossing Customs barriers.
Article 4 Individuals in charge of vehicles crossing Customs barriers and operators of shipless transportation providers, freight forwarding agencies, marine shipping agencies, postal service enterprises, and express mail providers as well as other entities who electronically transmit manifest data (hereinafter simply "manifest transmitter") shall, with designated time limits, transmit the manifest information to Customs as indicated by the scope of operations that has been filed with Customs.
Operators of operation sites under customs supervision, tally departments, consignors of goods for export, and others that have the obligation to transmit electronic data related to manifests shall transmit manifest data to Customs within designated time limits.
Where the manifest and relevant data is not transmitted pursuant to these Procedures, Customs may temporarily refuse to process the import and export declarations of relevant vehicles.
Where the manifest and relevant data cannot be transmitted to Customs as the result of computer malfunction or other special circumstances, with the approval of Customs it may be transferred in paper form to Customs within the designated time limit.
Article 5 Customs shall view the time when the primary data in the original manifest transmission is received as the time of transmission for import manifests; Customs shall view the time when the primary data in the advance manifest transmission is received as the time of transmission for export manifests.
Article 6 Manifest transmitters, operators of supervised locations, tally departments, and consignors of goods for export shall file their status with the directly subordinate Customs office or authorized Customs agency in the locality in which they do business, and submit the Filing Registration Form.
Where there is a change to the information filed with Customs, the manifest transmitters, operators of operation sites under customs supervision, tally departments, or consignors of goods for export shall go through file-change formalities with the Customs office by virtue of written application documents.
Article 7 Manifest transmitters may apply in writing to Customs to have their business secrets kept confidential; they shall explicitly list the information to be kept confidential.
Customs shall undertake to obligation to preserve confidentiality pursuant to relevant national regulations, properly storing the information related to business secrets provided by manifest transmitters and other relevant obligators.
Chapter II Administration of Entry Manifests
Article 8 Prior to the transmission of the original manifest, the individual in charge of a vehicle shall inform Customs of the estimated time of arrival at their destination port in China.
Prior to the arrival in port, the individual in charge of the vehicle shall inform Customs of the exact time of arrival.
When the vehicle arrives in a location that has a Customs office, the individual in charge of said vehicle shall carry out arrival declaration procedures at Customs.
Article 9 Where a vehicle entering Chinese territory is carrying goods or materials, the manifest transmitter shall transmit the primary information in the original manifest before the following deadlines:
