In order to standardize block chain information service activities, promote the sound and orderly development of block chain information services, protect the legitimate rights and interests of citizens, legal persons and other organizations, and safeguard national security and public interests, the Cyberspace Administration of China has formulated the Administrative Provisions on Block Chain Information Services (Draft for Comment), which are hereby issued for public comment. The public may provide feedback via the following means and methods:

1. Log onto the China Legal Information Website at http://www.chinalaw.gov.cn and click into the System for Soliciting Comments on Draft Regulations or Rules to make comments.

2. E-mail: jishu10@cac.gov.cn.

3. Address: Network Data and Technology Bureau of the Cyberspace Administration of China, No.11 Chegongzhuang Avenue, Xicheng District, Beijing Municipality, 100044, with the wording "Comments Sought" indicated on the envelope.

The period for feedback will end on November 2, 2018.

Administrative Provisions on Block Chain Information Services (Draft for Comment)

Article 1 The Provisions are formulated in accordance with the Cyber Security Law of the People's Republic of China, the Administrative Measures for Internet Information Services and the Circular of the State Council on Delegating the Cyberspace Administration of China to be in Charge of the Management of Internet Information Content, in order to standardize block chain information service activities, safeguard national security and public interests, protect the legitimate rights and interests of citizens, legal persons and other organizations, and promote the sound and orderly development of block chain technology and related services.

Article 2 The operation of block chain information services within the territory of the People's Republic of China shall be subject to the Provisions. Where there are provisions otherwise specified by laws and administrative regulations, such provisions shall apply.
For the purpose of the Provisions, block chain information services refer to the information services provided for the public-based block chain technology or systems through internet sites, application programs or otherwise.
For the purpose of the Provisions, block chain information service providers refer to the subjects or nodes providing the public with block chain information services, as well as the institutions or organizations providing the subjects of block chain information services with technical support; block chain information service users refer to institutions or individuals using block chain information services.

Article 3 The Cyberspace Administration of China will, as per its duties, take charge of the supervision, administration and law enforcement of nationwide block chain information services.
