To further standardize the naming of dietary supplement products, the General Office of the State Administration for Market Regulation has organized the drafting of the Guide to the Naming of Dietary Supplements (Draft for Comment) and hereby seeks public comments. Relevant entities and individuals can send their opinions via email to cpmczqyj@sohu.com before November 16, 2018.

Guide to the Naming of Dietary Supplements (Draft for Comment)

This Guide is formulated in accordance with the Administrative Measures for the Registration and Filling of Dietary Supplements (hereinafter referred to as "the Measures"), the Detailed Rules for the Registration, Review and Approval of Dietary Supplements (2016 Edition), and relevant laws, regulations, rules and norms, in order to standardize the registration and filling of the product names of dietary supplements. This Guide shall be applicable to the application for registration and filling of dietary supplements within the territory of the People's Republic of China.

I. Basic principles for naming dietary supplements
1. abiding by relevant provisions in the laws and regulations of the State;
2. adhering to the principle of "one product, one name";
3. reflecting the authentic attribute of the product, being simple, clear, and easy to understand, following the codes of Chinese language;
4. neither involving the function of disease prevention and treatment, nor misleading or deceiving consumers.

II. Composition of the name of a dietary supplement
The name of a dietary supplement is composed of a brand name, a generic name and an attribute name.
1. Brand name refers to a brand name legally registered and used on a dietary supplement, or a brand name conforming to the Trademark Law of the People's Republic of China (hereinafter referred to as "the Trademark Law") yet unregistered, indicating that the product is unique and distinct from other products of the same kind.
2. Generic name refers to a name indicating the special features of the product such as its principal raw material.
3. Attribute name refers to a name indicating dosage form, category, or other attributes.

III. Contents forbidden in the name of a dietary supplement
1. The following contents shall be forbidden in the brand name or generic name:
(1) terms that are false, exaggerated or absolute;
(2) terms expressing or implying the prevention or treatment function for a disease;
(3) terms that are vulgar or superstitious;
(4) terms of human tissues or organs;
(5) any symbol other than "?";
(6) other terms that may mislead the consumers.
The name of a dietary supplement shall not contain any personal name, geographical name, Chinese pinyin, letters, or numbers.
