Circular of the State Administration for Market Regulation and the Ministry of Ecology and Environment on Issuing the Supplementary Requirements for the Qualification Accreditation of Inspection and Testing Agencies and the Examination of Ecological and Environmental Monitoring Agencies

Administrations (departments or commissions) of market regulation and departments (bureaus) of ecology and environment of all provinces, autonomous regions and municipalities directly under the Central Government and the Administration for Market Regulation and the Environmental Protection Bureau of Xinjiang Production and Construction Corps,
In order to further standardize the qualification management of ecological and environmental monitoring agencies and improve the monitoring (testing) level of ecological and environmental monitoring agencies, the State Administration for Market Regulation and the Ministry of Ecology and Environment have formulated the Supplementary Requirements for the Qualification Accreditation of Inspection and Testing Agencies and the Examination of Ecological and Environmental Monitoring Agencies, which are hereby promulgated.
The present supplementary requirements for examination shall come into force as of May 1, 2019.
Supplementary Requirements for the Qualification Accreditation of Inspection and Testing Agencies and the Examination of Ecological and Environmental Monitoring Agencies
Article 1 The Supplementary Requirements are formulated in respect of the particularity of ecological and environmental monitoring agencies on the basis of the general examination requirements for the qualification accreditation of inspection and testing agencies, and shall be implemented together with the general examination requirements when the qualification accreditation of ecological and environmental monitoring agencies is examined.
Article 2 For the purpose of the Supplementary Requirements, ecological and environmental monitoring refers to the activities monitoring (testing) environmental quality and pollutant emissions for elements such as water and wastewater, ambient air and waste gas, seawater, soil, sediment, solid waste, organisms, noise, vibration and radiation by chemical, physical, biological and other technical means.
Article 3 For the purpose of the Supplementary Requirements, ecological and environmental monitoring agencies refer to the professional technical agencies that are established in accordance with the law, conduct ecological and environmental monitoring in accordance with the relevant standards or norms, issue data and results with proven effect on society and can bear the corresponding legal liability.
Article 4 Ecological and environmental monitoring agencies and their monitoring personnel shall abide by the relevant laws and regulations such as the Environmental Protection Law of the People's Republic of China and the Metrology Law of the People's Republic of China.
Article 5 An ecological and environmental monitoring agency shall establish systems and measures for preventing and punishing falsification, to ensure that the monitoring data issued by it is accurate, objective, authentic and traceable.
