To regulate and strengthen the management of subsidies for food and drug regulation and improve the efficiency of fund utilization, we have formulated the Interim Measures for Management of Subsidies for Food and Drug Regulation in accordance with the provisions of relevant laws and regulations and the budget management rules, which are hereby issued to you for conscientious compliance and implementation. If there are any problems in the implementation, please let us know in time.
Interim Measures for Management of Subsidies for Food and Drug Regulation
Article 1 In accordance with the provisions of the Budget Law of the People's Republic of China, the Opinions of the Central Committee of the Communist Party of China and the State Council on Comprehensively Implementing Budget Performance Management, other laws, regulations and the budget management rules with a view to regulating and strengthening the management of subsidies for the regulation of food and drugs (including medical devices and cosmetics, the same below).
Article 2 "Subsidies for food and drug regulation" (hereinafter referred to as "subsidies") as mentioned in these Measures refer to the subsidies which are arranged by central finance through special transfer payment to support local government departments for market regulation and medical products administration to implement food and drug supervision and administration and capacity building.
Article 3 The implementation period of subsidies shall be five years, and after which evaluation shall be made to determine whether to continue implementation and extend the implementation period in accordance with the relevant provisions of the State Council and the needs of the situation of food and drug regulation.
Article 4 Subsidies shall be allocated and managed in line with the following principles:
1. Fairness and equity, and highlighting key points. The allocation of subsidies shall follow the principle of fairness and equity, and embody the national food and drug regulatory policies and work priorities.
2. Each department fulfilling their responsibilities, and level-by-level management. Central and local government departments for finance, market regulation and medical products administration at all levels shall implement level-by-level management in accordance with their respective responsibilities.
3. Emphasizing performance and linking quantity with effect. Budget performance management shall be fully implemented, performance evaluation result-based incentive and restraint mechanisms shall be established, evaluation results shall be used as an important factor in the allocation of subsidies and be linked with the allocation of subsidies.
