Chapter I General Provisions
Article 1 The Administrative Measures for the Registration of Sole Proprietorship Enterprises (hereinafter referred to as the "Measures") are hereby formulated in accordance with the Law of the People's Republic of China on Sole Proprietorship Enterprises (hereinafter referred to as the "Law on Sole Proprietorship Enterprises") to verify the business qualifications of sole proprietorship enterprises and regulate the registration of sole proprietorship enterprises.
Article 2 The establishment, change and cancellation of a sole proprietorship enterprise shall be registered in accordance with the Law on Sole Proprietorship Enterprises and the Measures.
Article 3 A sole proprietorship enterprise before going through the procedures of examination and registration with the registration authority in accordance with the law and getting a business license shall not engage in business.
A sole proprietorship enterprise shall engage in business within the scope of registered items approved by the registration authority.
Article 4 Administrative departments for market regulation shall be the authority of registration for sole proprietorship enterprises.
The State Administration for Market Regulation shall be in charge of the registration of sole proprietorship enterprises throughout the country.
Administrations for market regulation of all provinces, autonomous regions and municipalities directly under the Central Government shall be in charge of the registration of sole proprietorship enterprises in their respective areas.
The administrations for market regulation at municipal and county (district) levels shall be in charge of the registration of sole proprietorship enterprises in their respective jurisdictions.
Chapter II Registration of Establishment
Article 5 The establishment of a sole proprietorship enterprise shall meet the requirements prescribed in Article 8 of the Law on Sole Proprietorship Enterprises.
Article 6 The name of a sole proprietorship enterprise shall comply with relevant provisions of administration of enterprise name registration and be in conformity with the form of the enterprise's liabilities and the business it will undertake.
Words such as "Limited", "Limited Liability" or "Company" shall not be used in the name of a sole proprietorship enterprise.
Article 7 When applying for the establishment of a sole proprietorship enterprise, the investor or his entrusted agent shall apply to the registration authority of the locality where the sole proprietorship enterprise is to be located for the registration of establishment.
Article 8 Registration items of a sole proprietorship enterprise shall include: name of the sole proprietorship enterprise, domicile of the sole proprietorship enterprise, name and domicile of the investor, amounts and way of contribution and scope of business.
Article 9 When applying for the registration of establishment, the investor shall submit the following documents to the registration authority:
