The Interpretations of the Supreme People's Court and the Supreme People's Procuratorate on Several Issues Concerning the Application of Law in Handling Criminal Cases Involving Organized Exam Cheating were adopted by the Judicial Committee of the Supreme People's Court at its 1765th Meeting on April 8, 2019 and by the 13th Procuratorial Committee of the Supreme People's Procuratorate at its 20th Meeting on June 28, 2019, and are hereby promulgated. The Interpretations shall take effective on September 4, 2019.
Interpretations of the Supreme People's Court and the Supreme People's Procuratorate on Several Issues Concerning the Application of Law in Handling Criminal Cases Involving Organized Exam Cheating
(adopted by the Judicial Committee of the Supreme People's Court at its 1765th Meeting on April 8, 2019 and by the 13th Procuratorial Committee of the Supreme People's Procuratorate at its 20th Meeting on June 28, 2019, and effective from September 4, 2019.)
To punish the perpetrators of crimes of organizing exam cheating, illegally selling or providing exam questions and answers, taking exams for others and so on and to safeguard the fairness and order of exams, the following interpretations are hereby made on several issues concerning the application of law in handling such criminal cases in accordance with the provisions of the Criminal Law of the People's Republic of China and the Criminal Procedure Law of the People's Republic of China:
Article 1 "National exams prescribed by law" as stipulated in Article 284 of the Criminal Law shall be limited to only the exams prescribed by the laws formulated by the National People's Congress and its Standing Committee.
According to the relevant legal provisions, the following exams shall belong to "national exams prescribed by law":
1. national college entrance exam, postgraduate entrance exam, self-taught higher education exam, adult college entrance exam and other national education exams;
