Health commissions of all provinces, autonomous regions, municipalities directly under the Central Government and Xinjiang Production and Construction Corps,

With a view to strengthening the specialized and standardized construction of childcare institutions and in line with the requirements of the Guiding Opinions of the General Office of the State Council on Promoting the Development of Care Services for Infants and Young Children under the Age of Three (Guo Ban Fa [2019] No. 15), the National Health Commission has organized the formulation of the Standards for Setting up Childcare Institutions (for Trial Implementation) and the Practices on the Management of Childcare Institutions (for Trial Implementation) (available to be downloaded from the website of the National Health Commission), which are hereby issued to you for your compliance and implementation.

Standards for Setting up Childcare Institutions (for Trial Implementation)

Chapter I General Provisions

Article 1 These Standards are formulated in accordance with laws and regulations including the Law of the People's Republic of China on the Protection of Minors and the Guiding Opinions of the General Office of the State Council on Promoting the Development of Care Services for Infants and Young Children under the Age of Three with a view to establishing specialized and standardized childcare institutions.

Article 2 A childcare institution is required to adhere to the principles of policy steering, general-benefit priority, safety and health, science and standardization, territorial management and classified guidance, fully mobilize the enthusiasm of social sectors and vigorously develop childcare services.

Article 3 These Standards shall apply to institutions that provide full-day care, half-day care, part-time care and casual care and other care services for infants and young children under the age of three upon registration at relevant departments and filing with competent health departments.

Chapter II Setup Requirements

Article 4 A childcare institution shall be set up under scientific planning and a rational layout in light of the economic and social development level, work basis and the masses' demand by taking into comprehensive consideration the characteristics of urban and rural development.

Article 5 A childcare institution is required to, in each new residential area, be set up upon planning commensurate with the scale of its permanent resident population; and in old urban areas and completed residential areas, improve relevant childcare institutions by a variety of methods to meet the residents' demands.

Article 6 A childcare institution is required to, in the construction of urban childcare institutions, take into full consideration the service demand for caring for infants and young children living with their migrant worker parents.

Article 7 A childcare institution is required to, in the building of comprehensive service facilities for rural communities, take into coordinated consideration the construction of childcare institutions.

Article 8 An employer shall be supported to provide welfare childcare services for its employees in the workplace, either separately or jointly with other units, which may be open to nearby residents if conditions permit.

Article 9 Building and improving childcare institutions in industrial clusters and employers with dense employee groups in various forms such as privately-run public school and publicly subsidized private school are encouraged according to the market-based mode.

Article 10 It is a requirement to exert the service function of public service facilities of urban and rural communities for caring for infants and young children and strengthen the functional linkage between community childcare institutions and community service centers (stations) as well as community facilities of health, culture and sports, etc.

Chapter III Premises and Facilities

Article 11 A childcare institution shall have its self-owned premises or premises with a lease term of not less than three years.

Article 12 The premises of a childcare institution shall be on selected construction land with good natural conditions and convenient transportation, meet the requirements for health and environmental protection, away from buildings, facilities and pollution sources that are harmful to the growth of infants and young children, and satisfy the requirements for earthquake resistance, fire prevention and evacuation, etc.

Article 13 The building of a childcare institution shall comply with relevant national standards and industry standards for relevant project construction, be equipped with living rooms that meet the requirements of such standards and service management rooms and supply rooms in light of the demands.
