Chapter I Genera Provisions

Article 1 In order to strengthen the administration of fuel gas in urban areas, guarantee the supply of fuel gas, prevent and reduce fuel gas accidents, protect the lives, properties and safety of the public, safeguard the legitimate rights and interests of fuel gas operators and fuel gas users, promote the healthy development of the fuel gas industry, these Regulations are hereby formulated.

Article 2 These Regulations shall apply to the fuel gas development and planning as well as emergency response assurance, fuel gas operations and services, fuel gas usage, protection of fuel gas facilities, prevention and handling of fuel gas accidents and other relevant administrative activities.
These Regulations shall not apply to the production and import of natural gas and liquefied petroleum gas (LPG), the pipeline transport of natural gas outside the city gates, the usage of fuel gas as raw material in industrial manufacturing as well as the production and use of biogas and straw gas.
The "gas" in these Regulations refer to gas that is used as fuel and that satisfies certain requirements and which includes natural gas (including coal gas), liquefied petroleum gas (LPG), artificial gas, etc.

Article 3 Work on fuel gas shall adhere to the principle of persistent overall planning, ensuring safety, safeguarding supply, regulating service as well as advocating energy-saving and efficiency.

Article 4 The People's Government at or above the county level shall strengthen its leadership over work involving fuel gas and shall include work on fuel gas into its national economic and social development plan.

Article 5 The administrative department for construction of the State Council shall be responsible for the administrative work on fuel gas nationwide.
The fuel gas administrative departments of the local People's Government at or above the county level shall be responsible for the administrative work on fuel gas within its respective administrative areas.
The fuel gas administrative departments and other relevant departments of the People's Government at or above the county level shall, in compliance with these Regulations and other relevant rules, be responsible for the administrative work on fuel gas within their respective scope of responsibility.

Article 6 The state shall encourage and support the scientific and technological research on fuel gas, promote the use of safe, energy-saving, highly efficient, environmentally friendly new technologies, new processes and new products on fuel gas.

Article 7 The People's Government at or above the county level shall establish a complete safety monitoring and administrative system, publicize and popularize the relevant laws, rules and regulations and safety knowledge on fuel gas, in the process, enhancing the safety consciousness of the general public towards fuel gas.

Chapter II Fuel Gas Development Plan and Emergency Response Assurance

Article 8 The administrative department for construction of the State Council shall meet with the relevant departments of the State Council and, in line with the national economic and social development plan, land use master plan, urban master plan and energy plan, jointly integrate this with the overall balance of gas resources in the country to formulate and implement a national fuel gas development plan.
The fuel gas administrative departments of the local People's Government at or above the county level shall meet with the other relevant departments and, in line with the national economic and social development plan, land use master plan, urban master plan, energy plan and fuel gas development plan of its higher level department, organize and formulate a fuel gas development plan for their respective administrative areas. After obtaining approval from the People's Government to which it belongs, implement the plan and submit the necessary reports to the next higher-level fuel gas administrative department.

Article 9 The content of the fuel gas development plan shall include the following: sources and types, means of supply and scale of fuel gas, layout and construction sequence of fuel gas facilities, construction site, safety protection range of fuel gas facilities, supply assurance measures and safety assurance measures for fuel gas, etc.

Article 10 The fuel gas administrative departments of the local People's Government at or above the county level shall adhere to the requirements of the fuel gas development plan, increase their investments in fuel gas construction as well as encourage social funds to be invested in constructing fuel gas facilities.

Article 11 When undertaking new constructions, renovations, fuel gas facilities or land set aside for construction of fuel gas facilities shall comply with the urban plan and the fuel gas development plan.
When constructing fuel gas facilities within the scope of the fuel gas development plan, the opinion on site selection issued by the urban planning administrative department shall seek the opinion of the fuel gas administrative departments to see whether the construction of the fuel gas facilities conform to the fuel gas development plan; for those who does not require the issuance of opinion on site selection, urban planning department shall, when issuing opinion on construction site planning permit or rural construction planning permit, seek the opinion of the fuel gas administrative departments to see whether the construction of the fuel gas facilities conform to the fuel gas development plan.
After completion of the fuel gas facility, the construction unit shall organize, in accordance with the law, the evaluation and acceptance of the facility and within 15 days after the said facility has passed the required evaluation, submit the evaluation report to the fuel gas administrative department.

Article 12 The fuel gas administrative departments of the local People's Government at or above the county level shall establish a complete fuel gas emergency reserve system, formulate a pre-emergency response plan and adopt comprehensive measures to enhance its fuel gas emergency support capabilities.
The fuel gas pre-emergency plan shall clearly specify the sources of the fuel gas and its types, means for obtaining the emergency supply, emergency handling procedures, emergency rescue measures and other content.
The fuel gas administrative departments of the local People's Government at or above the county level shall meet with the other relevant departments to conduct supervision and monitoring, forecasting as well as early warning of the situation of fuel gas supply.

Article 13 When there is a severe shortage, disruption in the supply of fuel gas or any unexpected incident, the local People's Government at or above the county level shall immediately use the reserves, conduct an emergency dispatch of fuel gas and implement other emergency measures.
