Brief Description:
1. The projects listed in this Catalogue refer to the major and restricted fixed assets investment projects invested and constructed by enterprises without using government funds.
2. Where any enterprise invests to construct a project excluded in this Catalogue without using government funds, with the exception of projects prohibited from investment in the State's laws and regulations and the special provisions of the State Council, it shall be subject to record-filing administration.
3. Relevant provisions shall be applied with respect to the examination and approval of projects as specially provided for in the State's laws and regulations and by the State Council.
4. This Catalogue provides for the approval authority of the government. In particular:
(1) The projects requiring the "approval of the competent investment authority of the State Council" as prescribed in the Catalogue shall be subject to the approval of the competent investment authority of the State Council together with the competent industry authority, among which major projects shall be submitted to the State Council for approval.
(2) The projects requiring the "approval of the competent investment authority of local governments" as prescribed in the Catalogue shall be subject to the approval of the competent investment authorities of local governments together with the competent industry authorities at the same level. The provincial government may specifically divide the approval authority of the competent investment authorities of local governments at various levels according to the local situations and the nature of related projects. But with respect to the projects that "shall be subject to the approval of the competent investment authority of a provincial government" as specified in the Catalogue, the approval authority thereof shall not be transferred to a competent authority at a lower level.
(3) Special authorization may be given to extra-large enterprises as for their decision-making right for investment according to the need of promoting economic development and the actual circumstances of different industries.
5. This Catalogue is a 2004 version. With the situation changing, it will be adjusted in due course.

Article 1 Agriculture, Forestry and Water Conservancy
Agriculture: Projects that involve reclamation of wasteland shall be subject to the approval of the competent investment authority of a provincial government.
Reservoir: The reservoir projects on international and trans-provincial (or regional, municipal) rivers shall be subject to the approval of the competent investment authority of the State Council, while the other projects shall be subject to the approval of the competent investment authority of a local government.
Other water projects: The projects on international rivers and projects concerning the trans-provincial (or regional, municipal) allocation and adjustments of water resources that need the coordination of the Central Government, shall be subject to the approval of the competent investment authority of the State Council, while the other projects shall be subject to the approval of the competent investment authority of a local government.

Article 2 Energy Resources
(I) Electric power
Hydraulic power stations: Projects constructed on major rivers and projects with a total installed capacity of 250 thousand kW or above shall be subject to the approval of the competent investment authority of the State Council, while the other projects shall be subject to the approval of the competent investment authority of a local government.
Pumped-storage power stations: shall be subject to the approval of the competent investment authority of the State Council.
Coal-fired power plants: shall be subject to the approval of the competent investment authority of the State Council.
Thermal power stations: The fire coal projects shall be subject to the approval of the competent investment authority of the State Council, while the other projects shall be subject to the approval of the competent investment authority of a local government.
Wind power stations: The projects with a total installed capacity of 50 thousand kW or above shall be subject to the approval of the competent investment authority of the State Council, while the other projects shall be subject to the approval of the competent investment authority of a local government.
