According to the Rules, if an enterprise as a legal person lawfully registered within the territory of China attempts to engage in operations of public transport of passengers and freight by railway, it has to lodge an application with the NAR and obtains a railway transport license after passing the examination. The corporate applicant is required to fulfill six requirements, including "having the ownership or the use right of railway infrastructure meeting the planning and national standards". The railway transport license will be valid for 20 years. Furthermore, the Rules note that enterprises with the ownership of railway infrastructure shall have the right to decide on their own the modes of railway transport operation, independently, cooperatively, in an entrusted way or by other legal means. Where the railway transport operation is carried out on a commission basis, the entrusted enterprise shall obtain the railway transport license. An enterprise without the ownership of railway infrastructure has to carry out business operations either independently or cooperatively.
