The Ministry of Industry and Information Technology ("MIIT") has recently released the Provisions on the Supervision and Administration of the Quality of Communications Construction Projects (the "Provisions"), with effect from July 1, 2018.
The Provisions contain revisions in six respects. The first is amending the content not compatible with reform guidelines. The second is establishing the in-process and ex-post quality supervision system. The third is forming the system of "inspection of randomly selected entities by randomly selected inspectors and the public disclosure of inspection results". The fourth is rolling out measures for the convenience of enterprises and citizens and offering optimized services. The fifth is providing stronger manpower for professional regulation. The sixth is improving the legal liability. Moreover, the Provisions create a system to supervise the quality of a communications construction project throughout the process, including the declaration for quality supervision before the construction kick-off, the preparation of the supervisory plan, routine checks, detection and rectification of quality issues, record-filing for the completion, special checks, circulation of notices. Furthermore, the Provisions call for creating a platform for the supervision and administration of the quality of communications construction projects, whereby the construction entities are enabled to handle various formalities, ranging from the declaration for project quality supervision, record-filing of completion acceptance inspections, to feedback on the rectification of project quality.
