The General Office of the Ministry of Housing and Urban-rural Development ("MOHURD") has recently released the Circular on Issues Concerning the Implementation of the Administrative Provisions on the Safety of Divisional and Partial Projects with Relatively Great Danger (the "Circular").
The Circular provides clarity on several issues, including the "scope of projects with relatively great danger", "contents of a specific construction plan", "attendees at the expert panel discussion", "content of the expert panel discussion", "modifications to a specific construction plan", "contents of a monitoring scheme", "acceptance inspectors", "criteria of experts" and "management of the expert pool". The Circular gives examples of projects falling into the scope of "divisional and partial projects with relatively great danger" and those under the scope of "divisional and partial projects with relatively great danger and beyond the designated scale", and expressly states that a specific construction plan prepared for a project with relatively great danger shall cover nine aspects, including the construction schedule and safeguards to ensure construction safety. Moreover, the Circular requires that, where the conclusion drawn through the expert panel discussion about a specific construction plan designed for a project with relatively great danger and beyond the designated scale says that "such plan could be cleared when certain modifications thereto have been made", detailed information shall be provided on what modifications should be made, and the entity undertaking the construction shall make the required modifications according to comments given by experts.
